Art. 1º Instituir a Política de Governança no âmbito do Tribunal
Regional do Trabalho da 13ª Região para assegurar a aderência aos
princípios, às diretrizes e às práticas de governança institucional.
Parágrafo único. As normas gerais e específicas de governança
institucional, assim como as de governança de gestão de pessoas, de
tecnologia da informação e comunicação e de contratações, emanadas
no âmbito do Tribunal, são consideradas parte integrante da Política
a que se refere esta Resolução.
Art. 2º Para fins desta Resolução, considera-se:
I – Alta Administração: gestores que integram o nível estratégico da
organização, com poderes para implementar os mecanismos e práticas
de governança da Instituição;
II – controles internos: conjunto de regras, procedimentos,
diretrizes, protocolos, rotinas de sistemas informatizados,
conferências e trâmites de documentos e informações, entre outros,
operacionalizados de forma integrada pela direção e pelo corpo de
servidores das organizações, destinados a enfrentar os riscos e
fornecer segurança razoável de que, na consecução da missão da
entidade, os objetivos e metas estabelecidos sejam alcançados, de
forma eficaz, eficiente, efetiva e econômica;
III – estruturas de governança: são as estruturas organizacionais e
instâncias de decisão e interlocução identificadas no intuito de
sistematizar o processo de condução das políticas de governança e
gestão das organizações;
IV – governança: mecanismos de liderança, estratégia e
accountability postos em prática para avaliar, direcionar e
monitorar a atuação da gestão, com vistas à condução de políticas
públicas e à prestação de serviços de interesse da sociedade;
V - instâncias internas de governança: esferas integrantes da
organização responsáveis por definir ou avaliar a estratégia e as
políticas, bem como monitorar a conformidade e o desempenho destas,
devendo agir nos casos em que desvios forem identificados. São
também responsáveis por garantir que a estratégia e as políticas
formuladas atendam ao interesse da coletividade, servindo de elo
entre sociedade e o agente público;
VI - instâncias internas de apoio à governança: esferas integrantes
da organização que realizam a comunicação entre partes interessadas
internas e externas à administração, bem como auditorias internas
que avaliam e monitoram riscos e controles internos, comunicando
quaisquer disfunções identificadas à alta administração;
VII – instâncias externas de governança: esferas não integrantes da
organização responsáveis pela fiscalização, pelo controle e pela
regulação. São autônomas e independentes, não estando vinculadas
apenas a uma organização;
VIII- instâncias externas de apoio à governança: esferas não
integrantes da organização responsáveis pela avaliação, auditoria e
monitoramento independente e, nos casos em que disfunções são
identificadas, pela comunicação dos fatos às instâncias superiores
de governança;
