5. JUSTIFICATIVA
O programa de estágio de estudantes de pós-graduação possui justificativa na Constituição
Federal, especificamente no artigo 193 que aponta o primado do valor social do trabalho.
Igualmente, no artigo 205 da Carta Magna, no qual, o legislador constituinte reconheceu como
dever democrático de toda a sociedade proporcionar uma educação inclinada para progressão
social do educando, capaz de prepará-lo para o exercício da cidadania e para qualificá-lo para
o trabalho. Acrescente-se que o artigo 2014, IV, da CF discorre sobre a formação para o
trabalho como elemento integrante das bases e diretrizes do processo educativo.
Ainda se justifica, no fato de o ensino, com as diretrizes estabelecidas pela Lei nº 9.394/96
(LDB), passar a ser regido pelo princípio da valorização da experiência extra-escolar (art. 3º, X,
da LDB), de modo a propiciar ao estudante vivenciar aspectos práticos ligados ao mundo do
trabalho.
Deste modo, a educação, a partir da ideia apresentada no texto constitucional, resultado de
uma série de processos formativos, desenvolvido em diversos setores da sociedade, inclusive
na Administração Pública, transcendendo o ambiente meramente acadêmico.
Assim, o estágio, dentro do contexto educacional e à luz do disposto no art. 3º, XI, da LDB,
surge como uma forma de vinculação entre a educação, o trabalho e as práticas sociais;
proporcionando uma estratégia curricular capaz de gerar uma efetiva vinculação entre o
educando e o mundo laborativo e, por conseguinte, em uma concreta progressão profissional
do estudante.
Sendo assim, tendo em vista o art. 1º da Lei nº 11.788/2008, que dispõe sobre o estágio de
estudantes, combinado com o inciso III do art. 44 da Lei nº 9.394/1996, que estabelece as
diretrizes e bases da educação nacional; bem assim, a necessidade e a importância de
ampliação das atividades formativas por estágio, incluindo-se os estudantes de pós-graduação,
com vista a efetiva preparação para os educandos e uma inserção qualificada no mercado de
trabalho, sem se descuidar do escopo educativo que notabiliza o instituto; e, ainda, o teor da
Resolução CSJT nº 307, de 24 de setembro de 2021, que dispõe sobre o estágio de estudantes
no âmbito da Justiça do Trabalho de primeiro e segundo graus, estabelecendo no art. 5º que o
estágio abrangerá os estudantes de educação superior na modalidade de pós-graduação,
observados os requisitos previstos nos arts. 2º e 4º da Lei nº 11.788/2008, entende-se pela total
